Terms of Use

1.Please read these Terms of Use carefully before using Jinghuachina services.

By accessing Jinghuachina services, creating an account, making purchases through Jinghuachina services, downloading Jinghuachina applications, joining any Jinghuachina online interactive communities, posting comments or creating personal profiles, or otherwise joining, viewing, accessing, or contributing to Jinghuachina user forums, blogs, or interactive features, you agree that you have read, understood, and agree to be bound by the Terms of Use. If you do not agree to be bound by these Terms of Use and comply with all applicable laws, you should immediately leave the Jinghuachina website or any other Jinghuachina services.

2.If you are under 18 years old, you must have your parents or legal guardian read and accept this agreement. Once you use Jinghuachina services, it indicates that your parents or legal guardian agree to these terms of use, and they agree to be responsible for your use of Jinghuachina services and any issues or claims related to your use of the service. If we believe you are under 13 years old, or if we believe you are under 18 years old but you claim to be over 18 years old, or if we believe you are over 18 years old but you claim to be under 18 years old, we may terminate and delete your personal information and account without warning.

Once you agree to these terms, you agree to waive your right to individual arbitration and class action.

Licenses and Restrictions

1.License.

Users are allowed to create hyperlinks to Jinghuachina services, provided that the link does not depict Jinghuachina products or services in a false, misleading, derogatory, or otherwise offensive manner.

1.2 Restrictions.

(a) Copy or download any user’s account or personal information for the benefit of any third party;

(b) Use any robot, spider program, data mining tool, crawler program, scraping tool, or other automated means to access or index Jinghuachina services or its systems, content, or any part or derivative thereof for any purpose;

(c) Interfere or attempt to interfere with the normal operation of Jinghuachina services;

(d) Construct or utilize framing techniques to incorporate any trademarks, logos, or other proprietary information (including images, text, page layouts, or forms) of Jinghuachina;

(e) Use Jinghuachina’s name, trademark, service mark, or logo in any meta tags or any other “hidden text”;

(f) Compile, repackage, disseminate, or otherwise utilize data extracted from Jinghuachina services.

The aforementioned behaviors are strictly prohibited, and any engagement in such behaviors requires the explicit written consent of Jinghuachina (which may include a written agreement signed by an authorized representative of Jinghuachina). Any unauthorized use of Jinghuachina’s services, content, or any part or derivative thereof will terminate any license or permission granted by Jinghuachina.

  1. Trademark

These and other graphics, logos, service marks, trademarks, and trade dress of Jinghuachina and its licensors (as the case may be) may not be used without the prior written consent of Jinghuachina or its licensors.

  1. Price

3.1 Price. The price of products on Jinghuachina’s service may differ from the price displayed in the user’s shopping cart, and the price may increase or decrease between the time the product is added to the cart and the time of actual purchase. In rare cases, the price of products on Jinghuachina’s service may be incorrect. If the price of a product on Jinghuachina’s service is incorrect and actually higher than the price provided at the time of purchase, Jinghuachina may decide at its own discretion:

(a) Contact the user for instructions or collect the payment for the product before shipping; (b) Cancel the order for the product and notify the user of the cancellation;

(c) Shipment at the wrong price, but the relevant losses are borne by the user.

3.2 Notice. Please note that this pricing policy only applies to products sold and shipped by Jinghuachina. If products are purchased from any third-party sellers on Jinghuachina’s service, different policies may apply if the pricing of the products is incorrect.

  1. Risk of loss

For all products purchased through Jinghuachina services, the risk of loss and ownership are transferred to the user once the product is delivered to the carrier.

  1. Product description

The products sold on Jinghuachina service contain descriptions directly provided by the publisher, manufacturer, developer, or distributor of the product. Jinghuachina does not represent or guarantee the accuracy or completeness of these product descriptions. If a user purchases a product from Jinghuachina and the product does not match the description on the Jinghuachina service, the user’s sole remedy is to return the product in unused condition and receive a refund of the purchase price.

  1. User age

Our products and services are marketed to and intended for purchase by adults or with the consent of adults. Persons under the age of 18 (“minors”) are not allowed to use the Jinghuachina website without the supervision of their parents or legal guardians. Furthermore, we do not intentionally collect or request personal information from children under the age of 13, nor do we intentionally allow such individuals to register online accounts or post personal information on our website. If we become aware that a child under the age of 13 has provided any personal information to the Jinghuachina website, we will promptly delete such information.

  1. Termination of use

7.1 Termination of Rights. Jinghuachina may, at its sole discretion, issue a warning, temporarily suspend, indefinitely suspend, or terminate any user’s right to use or access all or part of Jinghuachina’s services, including any accounts therein, for any reason (including but not limited to violation of the Terms of Use, Jinghuachina’s belief that such access would violate any applicable law or would harm the interests of Jinghuachina, any Jinghuachina provider, or other users, or could cause economic loss or legal liability to them), without further notice.

7.2 Restricted Users. In certain circumstances, Jinghuachina may, in its sole discretion, provide a written notice (“Restriction Notice”) to a user (“Restricted User”) informing the Restricted User of: (i) the termination of its right to use or access any part of Jinghuachina’s services, including the right to use, access, or create any account; (ii) Jinghuachina’s refusal to provide any services to the Restricted User; and (iii) any subsequent orders placed by the Restricted User will be cancelled. Other conditions may apply and shall be clearly stated in the Restriction Notice.

  1. Compensation

(i) The user’s use of Jinghuachina services may result in (ii) any suspected violation or breach of the terms of use, or (iii) the user’s violation of any law or infringement of third-party rights. Jinghuachina reserves the right, at the expense of the user, to assume exclusive defense and control over any matter for which the user is required to compensate Jinghuachina, and the user agrees to cooperate with Jinghuachina’s defense of such matters. This defense and compensation obligation is intended to extend to the maximum extent permitted by law and shall remain in effect throughout the terms of use and your use of Jinghuachina services.

  1. Notice

The user agrees to communicate electronically with Jinghuachina, whether through email addresses associated with Jinghuachina or posted on Jinghuachina’s services. The user confirms and agrees that any communication posted via email or on the Jinghuachina service meets any legal requirements for such communication to be made in writing.

  1. Disclaimer and Limitation of Liability

10.1 Disclaimer.

(a) Jinghuachina assumes no responsibility or makes any express or implied warranties for any user created content posted on or through the Jinghuachina service. The content created by users may not necessarily reflect Jinghuachina’s views or policies. The personal profiles and third-party applications created and published by users on Jinghuachina services may contain links to other websites. Jinghuachina assumes no responsibility for the content, accuracy, or views displayed on these websites, and Jinghuachina does not necessarily investigate, monitor, or check the accuracy or completeness of these websites. The inclusion of any linked websites on Jinghuachina’s services does not imply Jinghuachina’s endorsement or approval of these linked websites. When you visit these third-party websites, you are responsible for bearing the risks on your own. Jinghuachina shall not be held responsible for the behavior of any user of its services, whether online or offline.

(b) We are not responsible for any third-party advertisements or applications published on or provided through the JinghuaChina service, or available on the JinghuaChina service; And to the maximum extent permitted by applicable laws, we do not assume any responsibility for any goods or services provided by third-party advertisers on Jinghuachina services.

10.2 Limitation of Liability.

(b) Limitation of Liability. Within the maximum scope permitted by applicable laws, our cumulative liability related to Jinghuachina services shall not exceed 100 US dollars (or its equivalent in local currency, if applicable) under any circumstances.

The provisions in these Terms of Use are divisible. If for any reason any provision of these Terms of Use is found to be wholly or partially invalid or unenforceable in any applicable jurisdiction, such provision shall cease to be effective to the extent of invalidity or unenforceability in that jurisdiction, but shall not affect its validity or enforceability in any other jurisdiction or the remaining provisions of these Terms. Jinghuachina’s failure to exercise or enforce any rights or provisions in these Terms of Use shall not be deemed a waiver of such rights or provisions.

  1. Applicable Law

Applicable laws. The Jinghuachina service is created and managed by Jinghuachina located in China. The terms of use are governed by Chinese law, but do not apply any principles of conflict of laws.

  1. Claims described in this section.

13.1 Necessary informal dispute resolution. If you have a claim against JinghuaChina, or if JinghuaChina has a claim against you, you and JinghuaChina must first attempt to resolve the claim informally, and then either party may initiate arbitration regarding the claim. You and Jinghuachina will, in good faith, negotiate for a period of 60 days or longer regarding the resolution of any claim from the date you or Jinghuachina receive a written notice of claim from the other party (“claimant notice”). The specific period shall be jointly agreed upon by you and Jinghuachina in writing (via email) (“informal resolution period”).

13.2 You should send any claim notification via email to Junghuachina@gmail.com We will send you any claim notification. Any claim notice sent by either party must (i) include the sender’s name, address, email address, phone number, and any relevant purchase information; (ii) Clearly state the specific relief measures requested.

Before the end of the informal resolution period, neither you nor Jinghuachina may file a claim through arbitration (or court). During the informal resolution of the claim, the statute of limitations and any deadline for submitting fees will be suspended from calculation.
